Service Terms and Conditions

These Service Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“customer”, “you”) and American Bin Washers, LLC (“American Bin Washers”, “company”, “we”, “us”, or “our”) as an authorized user of such services provided by the company and any of its subsidiaries.
 

These Service Terms and Conditions, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by American Bin Washers, LLC (collectively, the “Agreement”), constitutes the entire agreement between American Bin Washers, LLC, and you regarding the trash bin cleaning service. By using the service, you confirm your acceptance of, and agree to be bound by, this Agreement.

These Service Terms and Conditions constitute a legally binding agreement concerning your access to and use of the http://www.americanbinwashers.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Service Terms and Conditions.

1. Service

​

American Bin Washers, LLC provides a mobile trash bin cleaning and power washing service for both residential and commercial trash bins. Residential service will be performed and billed on a subscription basis (exception is a One-Time Service).

2. Customer Responsibilities

​

In order for American Bin Washers, LLC to provide its services, the customer must abide by the following conditions, or service could be interrupted, postponed, or terminated.

​

• Trash bin(s) must be empty and available by the curb or alley. 

• Trash bin(s) must be free of un-bagged trash and animal waste. Bins containing unbagged feces or cat litter, chemicals, oils, any petroleum-based products, oil-based paint, glue or other adhesive, or hazardous waste of any kind will not be cleaned. No exceptions will be made.

• If a service visit is requested to be “skipped”, the customer must notify American Bin Washers the day before their scheduled service visit. 

• A vacation hold may be placed on service.  The customer must notify American Bin Washers, LLC by phone or email 7 days before scheduled service. The service will be temporarily suspended, and the customer will not be charged until service resumes.

If any of the above conditions are not met, American Bin Washers, LLC will not perform the service(s) and the customer will be responsible for a minimum $10 Trip fee or a full or partial payment determined by American Bin Washers. If American Bin Washers, LLC was not able to perform the service, a door hanger with the reason will be left on the trash bin or front door.

 

NOTE: American Bin Washers, LLC will not clean severely damaged bins, a door hanger with the trash haulers name and phone number will be left on the trash bin or front door. It is solely the customers responsibility to call their trash hauler and request new trash bins.

3. American Bin Washers, LLC Responsibilities

​

American Bin Washers, LLC will schedule the customer’s service on a pre-planned route and notify the customer leading up to the day of service via email and/or text message.  American Bin Washers, LLC will attempt to service all trash bins on its pre-planned route. Once the customer’s trash bins have been serviced, the customer will be invoiced, and their stored credit card will be automatically charged for the service.

If American Bin Washers, LLC is unable to provide its service(s) on the scheduled day due to inclement weather, vehicle maintenance, unforeseen events or otherwise, it will make every attempt to notify the customer in advance and reschedule the customer to the next available opportunity. Due to route scheduling conflicts and/or extended inclement weather, the service visit may be cancelled until the following scheduled service date.  The customer will not be charged if service cannot be performed due to inclement weather or vehicle maintenance.

All trash bins designated for cleaning by the customer will be tagged at the first servicing appointment. These tags are required to stay on the designated trash bins at all times and not be tampered with. American Bin Washers will only service trash bins that have been tagged. Any other trash bins will only be serviced upon request by the customer and will be billed for the additional trash bins serviced at the current rate found on www.americanbinwashers.com.

 

NO TRASH BIN SWAPPING WILL BE ALLOWED!

4. Charges

​

The customer agrees to pay all charges for the service(s) and any applicable taxes. American Bin Washers, LLC reserves the right to adjust pricing at any time. Changes in pricing may be communicated to the customer via updates to the website and/or email. It is the customer’s right to choose to continue or discontinue the service at any time.  The service will continue on a recurring basis until cancelled by customer.  Customer may request a change to the selected service plan 7 days in advance of next service.

Recurring Payment Plans:

• Customer must have a Debit Card or Credit Card stored on file and have accepted automatic future charges.  

• Customers will be billed based on recurring payment plans on either the Monthly, Quarterly, Semi-Annual, or Annual service plans. i.e., Monthly plans will be charged in one-month increments, Quarterly plans will be charged in three-month increments, Semi-Annual plans will be charged in six-month increments, or the Annual plans will be charged in twelve-month increments.

• The customer is responsible for paying for the service requested regardless of the number of bins present and available for cleaning.

• Service is ongoing until the customer cancels service.

American Bin Washers, LLC will utilize industry leaders in payment processing to store customer’s credit card information safely and securely. Customer’s card will run automatically after service.

5. Referral Program

​

Existing subscription customers in good standing may be eligible to receive a onetime $10 credit per referral of a new first time paying subscription only customer. There is no limit to the Referral Program. American Bin Washers reserves the right to modify or cancel the referral program at any time with or without notice.

6. Modifications to Service Terms and Conditions and/or Customer Agreement

​

American Bin Washers, LLC reserves the right to modify and/or amend the Terms and Conditions and/or the Customer Agreement at any time by posting a revised Terms and Conditions and/or the Customer Agreement at http://www.americanbinwashers.com, and/or sending information regarding the amendment to the email address you provided to American Bin Washers, LLC.

7. Modifications to Service

​

American Bin Washers, LLC reserves the right to modify the service at any time for the betterment of our customers and the overall success of the service program with or without notice.

8. Default Payments

​

American Bin Washers, LLC reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges, or if the customer’s card issuer (or its agent or affiliate) seeks return of payments previously made to American Bin Washers, LLC. Such rights are in addition to and not in lieu of any other legal rights or remedies available to American Bin Washers, LLC. There will be a $10 FEE for rejected credit or debit card charges. It is the customers responsibility to keep a current and valid credit/debit card on file at all times.

9. Cancellation of Subscription Service

​

The customer may cancel a subscription service at any time. If subscription cancellation occurs before the value of a One-Time/Annual service (i.e., only two visits were completed on a Monthly Service Plan (total was $60) or only one visit on a Quarterly Plan (total was $45) or one visit on a Semi-Annual (total was $55), the customer will be charged the minimum service fee which is the equivalent of the One-Time/Annual Cleaning Rate for the number of bins cleaned.  Cancellation must occur 14 days in advance of the next scheduled service date. Cancellation notice is required via email.  Pre-payment refunds are not issued for cancellation of service.

10. Customer Information

​

We do not sell, trade, or rent customer’s personal identification information to others. American Bin Washers, LLC utilizes industry leading PCI compliant credit card information storage through their payment processor.

11. Sanitization and Disinfection

​

The customer understands that American Bin Washers, LLC’s high pressure hot water is a great defense against germs and the environments they thrive in, but that American Bin Washers, LLC cannot guarantee the complete elimination of all contagions within, around and on trash bins. American Bin Washers, LLC will make all reasonable efforts to sanitize and disinfect to the best of their ability but makes no claims to prevent disease and/or the spread of contagions.
